Athlete Sitter — Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Athlete Sitter website, applications, and services (collectively, the "Service"). The Service is operated by GBobble, LLC, an Illinois limited liability company ("GBobble," "we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility and Accounts

You are responsible for the information you provide when you create and use an account on Athlete Sitter.

• Athletes and trainers must be at least 13 years old to create and manage their own accounts.
• Parent and advertiser accounts are intended for adults. Parents may create and manage accounts and profiles for their children. Advertiser accounts are for promoting a business through approved advertising placements only.
• Children under 13 should not self-register as athletes or trainers. Any account used by a child under 13 must be created and managed by a parent or legal guardian.
• You must keep your contact information (such as your phone number and email address) accurate and up to date so we can contact you about your account.

You are responsible for all activity that occurs under your account. If you believe your account has been compromised, you must notify us promptly.

2. Acceptable Use

You agree to use Athlete Sitter only for lawful purposes and in a manner consistent with these Terms. You agree not to:

• Use the Service in any way that violates applicable law or regulation.
• Harass, threaten, defame, or otherwise abuse or harm other users.
• Post, send, or upload content that is fraudulent, misleading, obscene, hateful, or otherwise inappropriate.
• Attempt to access accounts or data you are not authorized to access, or interfere with the security, integrity, or performance of the Service.
• Use automated means (including bots, scrapers, or crawlers) to access the Service without our prior written permission.
• Use the Service to advertise or promote products or services except as expressly allowed by us (for example, through approved advertiser accounts).
• Use the Service to directly solicit other users outside of the approved advertising placements or tools we provide (for example, by sending unsolicited messages or promotions).

3. User Content

Athlete Sitter allows you to submit or display content, including messages, reviews, profile information, photos, and other materials ("User Content").

• You retain ownership of your User Content. These Terms do not transfer ownership of your content to us.
• By submitting User Content to the Service, you grant GBobble a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, use, reproduce, modify, display, perform, and distribute your User Content as reasonably necessary to operate, improve, and promote the Service.
• You represent and warrant that you have all rights necessary to submit your User Content and grant the license above, and that your User Content does not infringe or violate the rights of any third party.
• We may remove or disable access to any User Content that we believe violates these Terms or applicable law, or that poses a risk to users or the Service.

4. No Guarantee of Matches or Outcomes

Athlete Sitter helps connect parents, athletes, and trainers. We do not guarantee that you will find a suitable trainer, athlete, client, or any particular outcome (such as training results or bookings). Any agreements, payments, or arrangements between users take place directly between those users. We are not a party to those agreements and are not responsible for the conduct of users outside the Service.

5. Third-Party Services

Our use of third-party services (such as hosting, messaging, or email providers) is described in our Privacy Policy. By using the Service, you acknowledge that your use of those underlying services may also be subject to their terms and policies. We are not responsible for third-party websites or services that we do not control.

6. Intellectual Property and the Service

Athlete Sitter, including its design, text, graphics, logos, and software, is owned by GBobble or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights in and to the Service.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of any software used in the Service, except to the extent such restrictions are prohibited by law.

7. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, GBobble and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will be limited to the greater of (a) the total fees you have paid to us for use of the Service in the three (3) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

8. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless GBobble and its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your User Content, or (c) your violation of these Terms or applicable law.

9. Termination and Suspension

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if we need to do so to protect the Service or other users.

You may stop using the Service at any time. You can request account deletion or changes to your data as described in our Privacy Policy. Certain provisions of these Terms will survive termination, including those relating to intellectual property, disclaimers, limitations of liability, and dispute resolution.

10. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to the Service or these Terms will be governed by the laws of the State of Illinois, USA, without regard to its conflict of laws rules.

You and GBobble agree that any claim or dispute arising out of or relating to the Service or these Terms will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.

To the fullest extent permitted by law, you and GBobble agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative action.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. If we make material changes, we will take reasonable steps to notify you, such as sending an email or showing a notice in the product. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.
